Peppermint - New rulings

The Court of First Instance of Rome dismissed a motion against Telecom Italia and Wind, two of the main Italian internet service providers. The case can be summarize as follows. The music label Peppermint sent out more than three thousand letters to Italian web users, requiring the payment of a fine of 330 euros. According to the music company, Italian web users have exchanged Peppermint’s music through peer-to-peer systems. It is remarkable however that copyright infringements is a criminal infringement according Italian laws. It means that a private agreement, like the one proposed by Peppermint, could be unenforceable and could not produce any effect. Peppermint sued several access providers, pursuant to article 156 bis of Copyright Law, requiring the name and the addresses of the peer-to-peer systems users. Peppermint has collected several users’ log via a software company Logistep. Consumers associations and Data Protection Commissioner argued that ISPs disclosure of users’ logs and personal data (such as e-mails and addresses) represents an invasion of privacy. During the last two months the Court of First Instance granted several injunctions, ordering ISPs to reveal the addresses of their customers, identified by logs. Now, the same Court has changed its opinion – due also to Data Protection Commissioner Authority opinion – and have dismissed the most recent claims. The Court of Rome has not overruled its precedents, of course, but it is likely that the Court of Appeal will follow these last decisions.
