E-mail and copyright

UK – The High Court hold that forwarding an e-mail can infringe copyright law. According to the Court, the letter sent by Dansk's executive vice president Karl Jorgensen can be qualified as a new creation, and it can be protected by copyright rules. In fact the judges stated that “In the light of the evidence and having compared the letter to the earlier works upon which it was based, I have no doubt that its production did involve a substantial degree of independent skill and labour and that it does justify the subsistence of copyright. The effort expended by Mr Jorgensen was clearly significantly more than trivial.”For further information see: http://www.out-law.com/page-7768

Copie Presse v. Google (reprise)

Google, the worldwide famous search engine, has been condemned by the Tribunal of Brussels for copyright infringement. Google has been sued by Copiepresse, a group of 17 French- and German-language newspapers. According to Copiepresse, providing links from Google News to the papers' Web sites is illegal. The Court hold that this kind of linking violates the Belgian copyright act. The ruling also required that Google remove the copyrighted content from its web sites and pay a fine of € 25,000 per each day these contents have been published on its servers.This is the second condemnation for Google. Copiepresse started legal proceedings against Google in February 2006, for a similar case. After this first decision (September 2006), Google complied with the ruling, removing all the infringing materials from Google News as well from Google Belgium entirely.In the recent past, Microsoft has avoided to be sued, agreeing to remove links to the Belgian newspapers.

BRAZIL - Prepared Remarks of Attorney General Alberto R. Gonzales to Members of the Brazilian Business Community on International Intellectual Property Rights:
 
"Good afternoon.
    I am glad to be here with you in Rio de Janeiro and to have had the
opportunity yesterday and today to speak with my Brazilian colleagues about
the many issues that connect our two countries. This is my first trip to
this unique city, and in my short time here I have begun to understand how
it earned its reputation for spectacular beauty.
    Over the past two days I have had fruitful and candid discussions with
government officials and civic leaders, and I am pleased that we share a
common understanding of so many issues of importance to the people of
Brazil and the United States.
    One of those issues, the one I'm here to talk about today, is the
protection of intellectual property rights.
    As everyone here today knows, IP protection is undeniably an
international concern. It requires cooperation and a partnership that
bridges cultural and geographic distances to achieve common goals for our
citizens and our economies. And I am here to say that this partnership must
include a mutual commitment to enforce the intellectual property rights
that form the foundation of our dynamic global economy.
    I want to talk a little today about the nature of the issue as I see
it; what we've seen working, in both Brazil and the United States; and what
I think we can do next, together".

ParisExposed

The website parisexposed.com has been blocked by a federal judge of  Los Angeles, California. This website collected pictures, videos and other information regarding the famous heiress Paris Hilton. The court, judging an invasion of privacy, bars the publication and the release of several personal information, such as Paris’ Social Security number, health data and other personal information. Hilton's spokesman, Elliott Mintz, said: "I know what this has done personally and emotionally to Paris. As far as I'm concerned, this is the most disturbing intrusion upon the privacy of a public figure that I've ever witnessed".
