Rolex v. EBay

Germany’s highest judicial court on Thursday ruled that the German branch of the Internet auctioneer eBay must try to prevent attempts to sell fake Rolex watches on its website.

The Swiss luxury brand took eBay to court after a number of fake Rolex watches were offered for sale on the website between June 2000 and January 2001.

The court in Karslruhe in south-western Germany said that eBay was obliged to withdraw purported offers of Rolex watches immediately if there was reason to suspect that they were counterfeit, or if it was alerted to the fact by Rolex.

Very interesting legal web sites from Italy:

www.diritto.it edited by Mr. Francesco Brugaletta

Unfortunately in Italian only. They are worth a visit, in any case.

iTunes / EMI (chapter 2)

The storied British music company — pilloried for its conservatism by the Sex Pistols in the 1977 anti-label protest song EMI (Unlimited Edition) — took a surprisingly liberal step on Monday, becoming the first major label to drop so-called digital rights management, or DRM, software that restricts music copying. The company is gambling that music lovers won’t mind paying a little more — $1.29 versus .99 — for hassle-free, higher quality music files.
